What is a prenuptial agreement?

It's a written agreement made by a couple sometime before they get married and which  sets out what will happen to their assets, in the event that the relationship ends in divorce.

Is a prenuptial agreement relevant to us we are not wealthy?

We are all aware of the rich and famous and their prenuptial agreements, particularly in the USA e.g. Jay- Z and Beyonce and Mark Zuckerberg  and Pricilla Chan, however increasingly ordinary people in the UK are entering into prenuptial agreements setting out their intentions of what should happen to their assets if their marriage comes to an end.

Are these agreements even binding in the UK  Courts?

Not automatically , however following the 2010 case of Radmacher v Granatino   the  agreement is likely to be upheld, provided certain guidelines are followed prior to the making of a prenuptial agreement.

We are already married is it to late to make a prenuptial agreement?

You cannot make a prenuptial agreement, but can still make a postnuptial agreement and which again , is likely to be upheld  as binding, provided similar criteria to that set out in Radmacher v Granatino is followed.

How much will drawing up a prenuptial agreement cost us can't we just sort this out without a lawyer?

The Court would be unlikely to consider  an agreement as  binding, it it was drawn up between a couple without  a lawyer being involved  in the process.

 

Each party will require independent legal advice on the Agreement.
